Actions and Fines for Violations of the Nevada Privacy Law

Only the attorney general can proceed with action, there is no private right of action.

The attorney general can file an action of "unlawful acts". A violation of the notice / opt-out of sale requirements is unlawful if:

  • The violation is (willingly and knowingly) not remedied within the 30-day remedy period

  • Only applicable to notice-rights: the operator tries to mislead consumers in their notice to the detriment of the consumer. In this case: no 30-day remedy period is required

A district court may impose a temporary or permanent injunction and a civil penalty of max $5,000 per violation of the notice or opt-out of sale rights.
